This international congress aims to discuss procedural updates of the judicial process in Brazil, in European countries and in Latin American countries, in the light of fundamentally new technological challenges, especially those provided by artificial intelligence. It will take place on May 6, 2023, May 13, 2023 and May 20, 2023, with the panel of experts from 9AM to 11:30AM (Brasília) and the panel of works from 3PM to 5PM (Brasília).

The event, promoted by the Research Group CNPq Fundamental Rights, Environment, Society and Technology of the Catholic University of Santos (Brazil) and the Superior School of Advocacy of the Brazilian Bar Association, Núcleo Guarujá/SP (Brazil), will consist of three panels of specialists dedicated to the discussion of the theme of Fundamental Rights, civil procedure and technological updates, as well as a period for the presentation of works. Scheduled to take place on the 6th, 13th and 20th of May 2023, in a hybrid format, it intends the participation of students, teachers and researchers for the discussion of the indicated theme, its effectiveness and difficulties. On this occasion, it invites the academic community to present academic works, under the terms of this announcement. The presentation of the referred works will be done on May 06, 13 and 20, 2023, from 3 pm to 5 pm, online.

This congress is an opportunity to relate Fundamental Rights, the foundation of the constitutional system of Democratic States, and Civil Procedure, the backbone of the Judiciary's activities. In light of their interpenetration, it is noted that Constitutional Law and Procedural Law are present in debates in legal, national and international relations, especially with the increasing digitalization of the world and the consequent need to update legal norms and practices. The discussion of civil procedure is fundamental for the improvement of justice, especially in a context of technological and social changes. The use of AI technologies in the judicial system, for example, can bring significant advances in terms of efficiency, but it also raises questions about the protection of fundamental rights of citizens. Behold, AI technology can be used as a perpetrator or perpetrator of violations of Fundamental Rights, which makes it essential to discuss ways to regulate its use and guarantee the protection of rights; it is therefore as fallible as the person behind it. Cultural and legal differences between the countries involved can generate divergences in the approach to these issues, making it even more important to hold an international congress to promote the exchange of knowledge and experiences among participants.

MANIFESTO TO BE DEBATED

Brazil, March 30, 2023.


Considering the function of Fundamental Rights in the Constitutions of States to ensure, as the last safeguard, the protection of the Human Dignity of the members of society, regarding their relations with the State and also regarding the relations between individuals;
Considering the undeniable technological advances and the benefits that the implementation of new technologies has generated to the Brazilian judicial process in the last decade, especially with the electronic process, which has democratized the access to justice and facilitated the work of professionals of the Judiciary, the Lawyers, the Public Prosecutor and all the instances committed to the realization of Justice;
Considering that the volume of active cases in Brazil today orbits close to 70 million, approximately one active process for every three Brazilians, with a total of approximately twenty thousand judges in service, of which two thousand five hundred judges only in the state of São Paulo, to judge 25% of Brazilian cases;
Considering the technological revolution that language-generative artificial intelligence tools, such as LaMBA, GPT3 and GPT4, are effectively able to produce judicial texts and even present decisions for legal problems;
Considering the questioning of the international society of whether these tools are capable of taking into account relevant ethical and moral factors in legal decision-making. In addition, considering the responsibility of those who use these tools, since decisions based on algorithms can have significant consequences for people's lives.

Considering the absolute need for the legal community to reflect on the role of the Principles in the decision-making process, emphasizing axiology as a valid tool for hermeneutics, in the role of interpretation of legal norms;
Considering that the search for the values inscribed in the juridical Principles seems to be an imminently human activity, considering the historical, moral, ethical, emotional and technical foundations, all composing in an inseparable way the persona of the interpreter;
Considering, finally, the real concern of the possibility of bequeathing to artificial intelligence tools the decision-making processes of the provision of the State's jurisdictional services, as a way of increasing its efficiency;
The following safeguard is proposed for this purpose, which can be debated in this Congress, and potentially inserted as an individual Fundamental Right in article 5 of the Brazilian Constitution:
"it is guaranteed the right of the person to know and decide whether to be judged by an artificial intelligence tool or equivalent automated process, or by a human judge”
" it is guaranteed the right of the person to know and decide whether on one administrative demand will be decided by an artificial intelligence tool or equivalent automated process, or by a human server."
" it is guaranteed the right of the person to know if they are interacting with an artificial intelligence tool or equivalent automated process."
The above proposal is not intended to prevent the use of technologies, but rather to guarantee people the right to know and to choose whether they wish to carry out interactions with artificial intelligence tools or not.
It is expected this debate to grant the opportunity to the adoption of similar measures for jurists in their respective states.
The results of this debate will be shared with the members of the Brazilian National Congress and interested authorities.
